Isolation, fines for swine flu law breaches

People who defy medical health officers' beefed-up swine-flu isolation powers risk being fined and forcibly detained.

The Government on Monday added swine flu to the list of notifiable diseases.

This allows people who have been in contact with patients who have swine flu to be compulsorily isolated at home, and pupils and teachers who are patients or contacts to be excluded from schools.

These measures are in addition to the general powers of medical officers of health under the Health Act 1956 to isolate people considered at risk of spreading swine flu.

A person who disobeys medical officers' orders faces a $500 fine, plus $50 for each further day of non-compliance.

But it is more likely the officer would invoke the power in section 79 (4) of the act to "detain him, by force if necessary".

Anyone who leaves their specified place of isolation is liable to be "arrested by any officer of the Ministry of Health or by any member of the staff of the hospital or other place of isolation or by any constable, without warrant" and taken to the place of isolation.

As well, medical officers of health gain much wider powers - such as restricting travel, closing businesses and banning meetings - if the Prime Minister issues an epidemic notice, the Minister of Health gives authority or a state of emergency is declared.

Then the penalty for disobeying a medical officer of health's directions rises to a maximum of six months' jail and a fine up to $4000.

The director of public health, Dr Mark Jacobs, said yesterday the Health Ministry's preference was voluntarily compliance and that was working well.

"If we had a problem with that, our fall-back wouldn't be to take them to court and fine them. It would be to enforce isolation, because the purpose of this is public health.

"Public health is not served by fining them."

The preference was to isolate people at home, or at hospital if necessary, he said.

Asked if police cells could be used, he said it was "unlikely but is in theory a possibility."

And he said it was unlikely the powers triggered by ministerial order or emergency declaration would be needed, even if swine flu - influenza, A (H1N1) - spread widely.

It has been contained in New Zealand; the tally of confirmed cased yesterday was 17.

Worldwide, more than 25,000 cases, including 139 deaths, have been reported. Australia's total has passed 1200 cases, mostly in Victoria, and is rising rapidly.

A group of Gisborne Boys' High school students who travelled home from a school trip to Brisbane on Sunday were yesterday isolated at school for the day.

Those with flu symptoms were given Tamiflu and asked to stay at home in isolation. The group includes 16 students, two teachers and a parent.

Swine Flu? geez, i knew this horseshit was coming a long time ago, but again the label of Conspiracy Theory was set by the critics.

Really, lets look at what 'flu-like symptoms' really can be defined as, because it allows an abuse of power to be honest.
One report even confirmed this;

"They were treated and are being kept in isolation at a secret location."
Treated with what? TamiFlu? Yeah right!

Looking back at the Epidemic Preparedness Bill, here's a refresh on what even less power and freedom you have as a person.



Clause 19 amends sect.71 of the Health Act 1956 to allow Medical Officers with clear power to requisition land, building, food, drink, clothing, bedding, tents, and vechiles private or public.

This also allow under Sect.71a to allow police officers to use force if neccessary to assist Medical Officers performing powers under any sections under sect 70 or 71a.

This also includes police allowing to prevent people from any obstruction or hindering to this.

Subsection (2) allow police to enter any land, building, vechile, aircraft or ship, also to stop, inspect it or anything on it or in it.

A minimum of 6 months prison or $4000 fine or both is deemed onto any person violating this or refusing to comply with this.

Swine Flu Update & is it really a North American Influenza?

PARIS/BRUSSELS, April 27 (Reuters)

The virus spreading around the world should not be called "swine flu" as it contains avian and human components and no pig has so far been found ill with the disease, the world animal health body said on Monday. It would be more logical to call the virus "North American influenza", a name based on its geographic origin like the Spanish influenza, a human flu pandemic with animal origin that killed more than 50 million people in 1918-1919.

"The virus has not been isolated in animals to date. Therefore it is not justified to name this disease swine influenza," the Paris-based World Organisation for Animal Health, also known as the OIE, said in a statement. The European Commission said that the virus was not linked with pork. Robert Madelin, director-general of the Commission's health and food safety department, said in Brussels that no European Union trade restrictions on imports were planned since swine flu had nothing to do with the food chain.

The EU only imports insignificant numbers of live pigs and pigmeat products are not seen as a disease threat. The World Health Organization has ruled out any risk of infection from consuming pork, saying swine flu has not been shown to be transmissible to people through eating properly handled and prepared pork, or other products derived from pigs. Fears of a global flu pandemic grew after 103 people were killed in Mexico and new infections were found in the United States and Canada and possible cases as far afield as Europe, Israel and New Zealand.

The OIE, an intergovernmental organisation, warned that if the virus was shown to cause disease in animals, this could worsen the regional and global public health situation. Denmark, a major pork producer that exported nearly 2 million tonnes of pigmeat in 2008, said on Monday it was not putting any extra controls in place on pigs or introducing extra measures relating to pork production as a result of the flu threat.

The Danish food and agriculture ministry also said it had not received any information from the industry suggesting pork demand had been hit by concerns arising from the virus. It said it would monitor the situation closely in coming days.

Fears there could be a global flu pandemic which would hurt fragile world economies led to a broad-based decline in stocks, oil and other commodity markets on Monday. Grain and oilseed markets fells sharply on concern that the outbreak could reduce feed demand for pigs.

HPV vaccine Gardasil - May contain poison and infertility risks known

Merck has stopped promoting the mandatory use of Gardasil that targets the human papillomavirus (HPV). It's probably no coincidence that their turn-around comes at the same time that reports from the National Vaccine Information Center are surfacing about fainting and dizziness reported by dozens of patients as side effects of Gardasil. There are also some concerns that Gardasil may cause infertility.

An early version of the Virginia house bill contained a clause addressing liability issues "if a female who is inoculated with the HPV vaccine becomes incapable of naturally conceiving a healthy child carried to live birth or experiences impaired fertility as a result of the HPV vaccine".

Legislators got that idea because the vaccine contains Polysorbate 80, which is linked to infertility in mice. The Merck HPV vaccine also contains sodium borate which is a common roach killer in each of its three doses. The National Library of Medicine (NLM) of the National Institutes of Health notes of sodium borate that it "is now known to be a dangerous poison, it is no longer commonly used in medical preparations." That was published in 2005. Yet the FDA in 2006 approved the Merck vaccine with this "dangerous poison" to be "commonly used" in these vaccinations. The symptoms of sodium borate poisoning according to the NLM citation include many of the side effects being reported after less than six months of the vaccine usage. These include convulsions, collapse, and seizures that include twitching of facial muscles, arms, hands, legs, and feet.

How many of these young women taking this vaccine will find out that they are barren 10 to 15 years down the road and what will their options be if they are forced to take this drug because of legislation mandates?

Flu and Virus Outbreaks across parts of New Zealand

Influenza-like Virus...

A public health warning has been issued as an influenza-like illness does the rounds.

The Auckland Regional Public Health Service has been advised by schools of student absences due to coughs, vomiting and high temperatures.

Other problems include rapid breathing and chest pain.

Medical Officer of Health Craig Thornley says people need to stay home if they are sick to stop the risk of spreading the virus. He says people should wash their hands regularly and cough into their arm, rather than their hand.

Dr Thornley says this year's flu immunisation covers all the current virus strains in New Zealand, so people who have been vaccinated are likely to have protection. He says a flu vaccination at the start of winter is still the best protection available.


Norovirus outbreak...

Health authorities are concerned people are not paying attention to proper hygiene measures as another ward in Dunedin Hospital is closed from a suspected norovirus outbreak.

Yesterday a ward holding 18 people was closed after four of the patients succumbed to vomiting and diarrhoea.

Otago District Health Board infection prevention and control charge nurse manager Jo Stodart told the Otago Daily Times people who have had the virus or been in contact with people who had, must stay away from the hospital for 48 hours.

However, people who were so ill they needed to be admitted to the hospital should not stay away.

Mrs Stodart said the importance of thorough and frequent hand-washing could not be emphasised too strongly.

It is the third ward to close this week, with two closed to new patients and visitors after nine patients and three staff members fell ill with vomiting and diarrhoea on Sunday.

At least one scheduled surgery was also postponed as a result of the illness.

NZ-made flu drug MIS 416, promises many uses

Facial acne has helped a South Auckland company to develop a versatile drug it hopes will treat numerous serious illnesses, from influenza to radiation sickness.

Mangere biotech firm Virionyx makes the experimental drug from the shell of the pimple-causing bug "propionibacterium acnes". The drug, MIS 416, comprises the inert shell of the bacterium and a small amount of its inactivated DNA.

Although it is yet to be tried in humans, it has shown promise in animal trials.

In a Californian study, half the mice injected with the drug 24 hours after a lethal dose of radiation survived.

In another US trial, it delayed the onset of influenza symptoms and reduced their severity.

It was originally used as the "adjuvant" in an experimental vaccine against anthrax which provided 100 per cent protection in an animal trial. But it was noticed that 33 per cent protection was achieved in the control group, which got only the adjuvant.

An adjuvant in a vaccine amplifies the immune system's response.

Virionyx chief executive Simon Wilkinson said that although the exact mechanism of MIS 416's action was not known, it was clearly activating the innate immune system, the first line of defence against harmful invaders.

He said plans were under way to start a phase 1 human safety trialin Christchurch by next February.

"If that's successful we would like to move quickly to phase 2a [safety and efficacy] trial in hepatitis C to treat patients once a fortnight and over a three- to six-month period to see if we have a more tolerable, more effective alternative treatment to the existing interferon alpha."

If the trials went well, it could take five years before the drug was licensed for use, Mr Wilkinson said.

Virionyx hopes to tap the lucrative anti-flu market, now dominated by drugs such as Tamiflu. If successful against the flu, MIS 416 could provide an important first-line defence for health and emergency workers during a pandemic while vaccines are made.

Mr Wilkinson said the US defence establishment was keen for the development of drugs to treat radiation sickness, because of the perceived risk of a terrorist attack using a low-tech "dirty bomb" containing radioactive waste such as that from nuclear reactors.

He said MIS 416 also held promise as a treatment to reduce the damage caused by anti-cancer radiation therapy in non-cancerous cells.

Auckland University immunologist Professor John Fraser said the concept of adjuvants stimulating an innate immune response was well established, but this was the first time he had heard of one having such wide-ranging effects.

He said it needed to be backed up by hard evidence - until then "I would call it a curiosity"
